Abandoned Vehicles Policy

Torres Shire Council advises that it has adopted a Seizure and Disposal of Abandoned Vehicles Policy, (Reference Min 08/08/19), which pursuant to Section 100, Transport Operations (Road Use Management) Act, 1995, will enable Council to:

  • Remove any abandoned vehicles to a storage compound for a defined period where the vehicles will be available for the legitimate owner to claim,
  • Sell the abandoned vehicle by either tender or auction,
  • Convey to the Horn Island Waste Landfill Facility if the vehicle is deemed to be in a
    dilapidated condition beyond economical repair.

In accordance with Section 48 of the same Act, Council has the power to recover costs
from the owner/user of the vehicle for the costs incurred in seizure of such vehicle.

A notice will be placed on a prominent position of the vehicle for a period of seven (7) days
to enable the owner/user time to relocate the vehicle.
